እያንዳንዱ አባል ሀገር በሕግ ሥርዓቱ ውስጥ የማሰቃየት ተግባር ሰለባ የሆነ ሰው መፍትሔ እንደሚያገኝ እንዲሁም በተቻለ መጠን የተሟላ ማገገሚያን ጨምሮ ተፈጻሚነት ያለው ፍትሐዊና በቂ ካሳ የማግኘት መብት እንዳለው ማረጋገጥ አለበት
