Ethiopian Human Rights Commission Establishment Proclamation (As Amended)

2. Definitions

Unless the context requires otherwise, in this Proclamation:

1) “Appointee” means the Chief Commissioner for Human Rights, the Deputy Chief Commissioner, Deputy Commissioners for Women and Children Affairs and other Commissioner heading different thematic Human Rights areas appointed by the House in accordance with the Proclamation. Thematic areas include disability rights, civil and political rights and socio economic and cultural rights; (as amended)

10. Appointment

1. The Chief Commissioner, the Deputy Chief Commissioner and other Commissioners shall be appointed by the House.

2. The appointment of the Chief Commissioner, the Deputy Chief Commissioner and of other Commissioners shall be made as under the following selection procedure:

a) The appointees shall be recruited by a Nomination Committee to be formed pursuant to Article 11 hereunder;

b) The nominees shall have to receive the support of a two-thirds vote of the members of the Committee;

c) The list of nominees shall be presented to the House, by the Speaker, for it to vote upon;

d) The nominees shall be appointed upon receipt of the support of a two-thirds vote of the House.

11. Composition of the Nomination Committee (as amended)

1) The Nomination Committee shall have the following members:

a. The Speaker of the House………Chairperson;

b. The President of the Federal Supreme Court………………….Deputy Chairperson;

c. One member of the House to be elected by the joint agreement of opposition parties having seats in the House……………..….Member;

d. One member of the National Electoral Board of Ethiopia……………………………Member;

e. One member from the Ethiopian Inter-Religious Council;…………..…Member;

f. One member from House of Federation , and

g. One member from Civil Society Organizations.

2) Nominating Committee shall have independent and competent members who shall also fulfill the criteria, as appropriate, for appointment of Commissioner under Article 12 of the Proclamation.

3) The Nominating Committee shall follow a transparent and participatory public nomination process as well as use its own means to identify suitable candidates and submit to parliament nominees it has selected by a majority vote. To the extent possible, the list of nominees should take into consideration gender diversity and representation from different parts of the society.

12. Criteria for Appointment

Any person who:

1) is loyal to the Constitution of the Federal Democratic Republic of Ethiopia;

2) upholds respect for human rights;

3) is trained in law or other relevant discipline or has acquired extensive knowledge through experience;

4) is reputed for his diligence, honesty and good conduct;

5) has not been convicted for a criminal offence;

6) is an Ethiopian national;

7) is not a member of a political organization; (as amended)

8) is above thirty-five years of age may be an appointee.

፪. ትርጓሜ

የቃሉ አገባብ ሌላ ትርጉም ካላሰጠው በስተቀር በዚህ አዋጅ ውስጥ፤

፩. “ተሿሚ” ማለት በአዋጁ መሰረት በምክር ቤቱ የሚሾም የሰብአዊ መብቶች ዋና ኮሚሽነር፣ ምክትል ዋና ኮሚሽነር እና የሴቶችን እና ህፃናትን ጉዳይ የሚከታተል ምክትል ኮሚሽነር እንዲሁም ሌሎች የልዩ ልዩ ሰብአዊ መብቶች ዘርፍ ኮሚሽነሮች ማለት ሲሆን የዘርፍ ኮሚሸነሮች፣ የአካል ጉዳተኞች፣ የሲቪልና ፖለቲካ፣ ማኅበራዊ ባሕላዊና ኢኮኖሚ መብቶች ጉዳይን ይጨምራል፡፡ (እንደተሻሻለው)

፲. አሿሿም

፩. ዋና ኮሚሽነር፣ ምክትል ዋና ኮሚሽነርና ሌሎች ኮሚሽነሮች በምክር ቤቱ ይሾማሉ፡፡

፪. የዋና ኮሚሽነር፣ የምክትል ኮሚሽነርና የኮሚሽነሮች አሿሿም የሚከተለው የአመራረጥ ሥርዓት ይኖረዋል፡፡

ሀ) ተሿሚዎች በዚህ አዋጅ አንቀጽ ፲፩ መሰረት በሚቋቋመው ዕጩ አቅራቢ ኮሚቴ ይመለመላሉ፤

ለ) ዕጩዎቹም በኮሚቴው ሁለት ሦስተኛ ድምፅ የተደገፉ መሆን አለባቸው፤

ሐ) ዕጩዎቹ በምክር ቤቱ አፈ-ጉባኤ ለምክር ቤቱ ቀርበው ድምጽ የሚሰጥባቸው ይሆናል፤

መ) የቀረቡት ዕጩዎች በምክር ቤቱ ሁለት ሦስተኛ ድምጽ ሲደገፉ ይሾማሉ፡፡

፲፩. የዕጩ አቅራቢ ኮሚቴ ጥንቅር (እንደተሻሻለው)

፩. የዕጩ አቅራቢ ኮሚቴ የሚከተሉት አባላት ይኖሩታል፤

ሀ) የምክር ቤቱ አፈ-ጉባዔ ……………. ሰብሳቢ፤

ለ) የፌደራል ጠቅላይ ፍርድ ቤት ፕሬዚዳንት……………………..…… ም/ሰብሳቢ፤

ሐ) በምክር ቤቱ መቀመጫ ካላቸው ተቃዋሚ ፓርቲዎች መካከል በጋራ ስምምነት የሚመረጥ አንድ ሰው ………………………….. አባል፤

መ) ከብሔራዊ ምርጫ ቦርድ አባላት አንድ ሰው…. አባል፤

ሠ) ከኢትዮጵያ ሃይማኖት ተቋማት ጉባዔ አንድ ሰው…………………………………………… አባል፤

ረ) ከፌደሬሽን ምክር ቤት አንድ ሰው…………. አባል፤

ሰ) ከሲቪል ማኅበራት አንድ ሰው…………….. አባል፤

፪. የዕጩ አቅራቢ ኮሚቴ አባላት ገለልተኛነታቸውና ብቃታቸው የተረጋገጠ፣ እንደ አግባብነቱ በአዋጁ አንቀጽ ፲፪ ስር የተዘረዘሩትን ለኮሚሽነርነት የሚያበቁ መመዘኛዎችን የሚያሟሉ ሊሆኑ ይገባል።

፫) ኮሚቴው የራሱን መንገድ በመጠቀም እንዲሁም ግልጽ አሳታፊ አሰራር በመዘርጋት በሕዝብ ጥቆማ ከቀረቡ ሰዎች ውስጥ፤ መስፈርቱን የሚያሟሉ በአብላጫ ድምፅ የተደገፉ ዕጩዎችን ለምክር ቤቱ ያቀርባል፡፡ የዕጩዎች ዝርዝር በተቻለ መጠን የልዩ ልዩ ሕብረተሰብ ክፍሎች እና የጾታ ስብጥርን ከግምት ያስገባ መሆን ይኖርበታል።

፲፪. ለሹመት የሚያበቁ መዘኛዎች

ከዚህ በታች የተመለከቱትን መመዘኛዎች የሚያሟላ ሰው ሊሾም ይችላል፡፡

፩. ለኢትዮጵያ ፌዴራላዊ ዲሞክራሲያዊ ሪፐብሊክ ሕገ መንግሥት ተገዥ የሆነ፤

፪. ለሰብአዊ መብቶች መከበር ተቆርቋሪ የሆነ፤

፫. በሕግ ወይም አግባብ ባለው ሌላ ሙያ የሰለጠነ ወይም በልምድ ሰፊ ዕውቀት ያካበተ፤

፬. በታታሪነቱ፣ በታማኝነቱ እና በሥነ ምግባሩ መልካም ስም ያተረፈ፤

፭. ከደንብ መተላለፍ ውጭ ባለ በሌላ የወንጀል ጥፋት ተከሶ ያልተፈረደበት፤

፮. ዜግነቱ ኢትዮጵያዊ የሆነ፤

፯. የማንኛውም ፖለቲካ ድርጅት አባል ያልሆነ፤ (እንደተሻሻለው) እና

፰. ዕድሜው ከ፴፭ ዓመት በላይ የሆነ፡፡
